Who is Eligible for Alternative Sentencing?
Defendants who have not commited the worst crimes and do not have a mandatory sentence imposed on them. (Charges which carry a mandatory sentence can sometimes be replaced with a lessor charge or dropped) Defendants who have not committed numerous crimes. Defendants who do not pose a risk to the community.
Some methods of alternative sentencing:
Restitution: Fines go to the state. Restitution is money paid by the defendant to the victim to compensate for losses. Usualy restitution is just one part of a sentence.
Suspended Sentences and Probation: A prison sentance can sometimes be 'suspended'. This is time that is put on hold if the defendant complies with certain obligations, for example, probation, or completion of a drug treatment program. Defendants put on probation are given 'conditions of probation'. These conditions may include; paying a fine or restitution, participation in community service, submiting to regular alcohol or drug testing, avoiding certain people or places, and obaying all laws.
Diversion: Some cases can be 'diverted' out out the criminal justice system. This gives the defendant a chance to escape the stigma of a criminal conviction. Defendants whose cases are diverted will usually need to participate in a treatment or rehabilitation program. Criminal charges are dropped (or not brought) upon successful completion of the program.
Electronic Monitoring, House Arrest, or Home Detention: Participant is fitted with an electronic device, an ankle bracelet, which limits and monitors the defendant's wherabouts at all times. The participant may attend approved activities such as school, work, and church.
Work Release Programs: A participant in this program goes to a designated work site, usualy on a daily basis to perform physical labor. At the end of the work day the participant is allowed to go home.
Drug Treatment Options: Strict programs including random drug testing.
Sober Living: The participant is housed in a private facility geared for alcohol abuse problems. There are individual and group therapy sessions, along with curfews and house rules which are strictly enforced.
Community Service: Participants work in city organizations or perform clean up duties.
