Penalties

The type of criminal charges will depend in part on the value of the property that was involved.  Property worth less than $250 is considered petty theft.  If over $250, it is considered grand theft and may be classified as a felony. 

Larceny of property in value over $250, penalties can go up to 5 years in jail and $25,000 fine

Shoplifting items valued at more than $100, penalty for a first offense can go up to 2 1/2 years in jail and fine of $1000.  

Penalties can get particularly severe if the defendant has a prior criminal record, prior theft crime conviction, if the defendant caused bodily harm while commiting the crime, or if the defendant used a weapon while commiting the crime.   . 

Breaking and Entering with intent to commit a felony, penalties can go up to 20 years in prison.
